General Terms and Conditions for use of the Research Repository

Concerning depositors, quality. data protection and copyright. 

  1. Items may only be deposited by accredited members of the institution, or their delegated agents. 
  2. The administrator only vets items for the eligibility of authors/depositors, relevance to the scope of the repository, valid layout & format, and the exclusion of spam. 
  3. The validity and authenticity of the content of submissions is the sole responsibility of the depositor. 
  4. Items can be deposited at any time, but will not be made publicly visible until any publishers' or funders' embargo period has expired. 
  5. Ensuring compliance with data protection legislation is entirely the responsibility of the authors/depositors. 
  6. Any copyright violations are entirely the responsibility of the authors/depositors. 
  7. If the repository receives proof of copyright violation, the relevant item will be removed immediately.

Key conditions of Repository Use

Personal Data

Data containing personally identifiable information cannot be uploaded at this point. More information on what constitutes personal data as well as anonymisation is available from the UL Data Protection Unit at dataprotection@ul.ie. Please contact the RDM team for guidance on alternative repositories that can handle personal data.

Data types 

The following categories of data must not be uploaded to the UL Research Repository  

  • data provided in confidence 
  • data that would contravene any third-party agreement.  

Copyright

You should not upload data containing copyrighted content that is not owned by either the University of Limerick or its employees, except in cases where that content is either licensed so as to permit derivations, or permission to upload and/or publish the data has otherwise been explicitly granted by the copyright holder.  

Commercial licensing 

You should consider whether the data to be uploaded may be licensed commercially before deciding to freely release it to the public. Information and advice about the commercial licensing of datasets can be sought from UL’s Technology Transfer office, however, you should ensure that you obtain your own legal advice regarding the commercial licensing of datasets specific to your circumstances.  

Research Repository Deposit Agreement

COVERED WORK 

I wish to deposit my material in the University of Limerick Institutional Repository. Research referred to below as "Work" is covered by this agreement and when I deposit my Work, whether personally or through an assistant or other agent, I agree to the following: 

NON-EXCLUSIVE RIGHTS 

Rights granted to the Institutional Repository through this agreement are entirely non-exclusive. I am free to publish the Work in its present version or future versions elsewhere. 

I agree that University of Limerick may electronically store, copy or translate the Work to any medium or format for the purpose of future preservation and accessibility. The University of Limerick is not under any obligation to reproduce or display the Work in the same formats or resolutions in which it was originally deposited. 

DEPOSIT IN UNIVERSITY OF LIMERICK RESEARCH REPOSITORY 

I understand that work deposited in the institutional repository will be accessible to a wide variety of people and institutions
- including automated agents 
- via the World Wide Web 

I understand that once the Work is deposited, metadata will be incorporated into public access catalogues. This citation to the Work 
will always remain visible, although the author retains the right to update the Work. Removal of the item can be made after discussion with 
the institutional repository administrators. 

I AGREE AS FOLLOWS: 

  • That I have the authority of the authors to make this agreement and to hereby give University of Limerick the right to make available the Work in the way described above. 
  • That I have exercised reasonable care to ensure that the Work is original, and does not to the best of my knowledge breach any laws including defamation, libel, copyright and data protection. 
  • University of Limerick does not hold any obligation to take legal action on behalf of the Depositor, or other rights holders, in the event of breach of intellectual property rights, or any other right, in the material deposited.
